1. About These Terms
These Terms of Service ("Terms") are a legal agreement between you and Hey Byron ("we," "us," "our") that govern your use of the Hey Byron mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Who Can Use the App
2.1 Age Requirements
Hey Byron features events at venues, some of which are licensed and serve alcohol. By using the App, you acknowledge that some events are restricted to 18+ attendees, you are responsible for verifying age requirements before attending events, and venues are responsible for age verification at their events. You will confirm your age on first launch of the App. Events at licensed venues may be marked with age restrictions where applicable (18+).
2.2 No User Accounts for Regular Users
Regular users do not need to create an account. You can browse, discover, and save events completely anonymously without providing any personal information. Your preferences and saved events stay on your device and are never uploaded to our servers.
2.3 Business Accounts
Byron Bay businesses can apply for business accounts to create profiles and post events on the platform. Business accounts are subject to our separate Business Service Agreement, which covers the account application and approval process, service fees and billing terms, business responsibilities and content requirements, and event posting capabilities. To apply for a business account, please contact info@heybyron.com.au. Business account holders must comply with both these Terms of Service and the Business Service Agreement.
3. What the App Does
3.1 For All Users
Hey Byron is a discovery platform for local Byron Bay events and businesses. Features include browsing local Byron Bay businesses and venues, discovering upcoming events in the Byron Bay area, searching and filtering events by interest categories, using location services (with permission) to see nearby events and distances, saving favorite events (stored on your device only), adding events to your device calendar (with permission), setting interest preferences to personalize recommendations (stored on your device only), and setting distance filters for location-based browsing (stored on your device only).
Important: Regular users remain completely anonymous. No account, no personal data collection.
3.2 For Businesses
Approved Byron Bay businesses can create and manage business listings, post events with images and videos (automatically optimized), update business information, and view anonymized analytics (event view counts only). Not all business accounts include event posting capability. This is determined during the application process.
3.3 Our Role as a Platform
Hey Byron is a neutral discovery platform. We are a platform that allows businesses to list their own events, an advertising and discovery channel (like a local directory or magazine), and a technology provider that hosts public business information.
We are not event promoters or organizers, responsible for event content, safety, or operations, liable for incidents at listed events, involved in alcohol service or venue management, ticket sellers or payment processors, or collecting or selling user personal data.
Businesses are solely responsible for accuracy of their event information, event operations and safety, compliance with liquor licensing laws, responsible service of alcohol at their events, incidents that occur at their events, content they post on the platform, and age verification at their events.
We simply provide a platform for businesses to advertise events to the community.
3.4 No Guarantee of Accuracy
While we strive to keep information current, we do not guarantee that all event information is up-to-date or correct, all businesses are currently operating, event dates, times, or details haven't changed, links to external websites will work, location-based distance calculations are perfectly precise, or events will occur as advertised. You should always verify event details directly with the business or venue before attending.
3.5 Changes to the App
We may update, modify, suspend, or discontinue any feature of the App at any time without prior notice. Platform features may change without notice. We are not liable if the App becomes unavailable temporarily or permanently.
4. Content and Behavior Rules
4.1 Prohibited Content
No one may post content that contains false, misleading, or deceptive information, promotes illegal activities, contains adult, sexual, explicit, or inappropriate content, includes spam or unsolicited advertising, infringes copyright (using images or videos without permission), contains personal information of others without consent, is discriminatory, hateful, offensive, or harassing, impersonates another person or business, violates alcohol advertising regulations (see Section 4.2), targets or appeals to minors (under 18), or promotes dangerous or harmful activities.
4.2 Responsible Alcohol Promotion
Many events take place at licensed venues that serve alcohol. If posting alcohol-related content, you must comply with Australian alcohol advertising laws, including the Alcohol Beverages Advertising Code (ABAC), NSW Liquor Act 2007 and regulations, Australian Association of National Advertisers (AANA) Code of Ethics, and Liquor and Gaming NSW requirements.
Regarding prohibited alcohol content, you must not encourage excessive or rapid alcohol consumption, depict or encourage underage drinking (under 18), associate alcohol with driving, machinery, or dangerous activities, link alcohol to improved physical, mental, or sexual performance, suggest alcohol is essential for social success, show people appearing under 25 consuming alcohol, use imagery or language appealing to minors, encourage irresponsible alcohol consumption, promote drinking games or consumption competitions, offer unlimited alcohol for a fixed price ("all you can drink"), show alcohol consumption in unsafe contexts, create peer pressure to consume alcohol, or make health or therapeutic claims about alcohol.
For alcohol-related events, content must be appropriate only for adults 18+, must not target or appeal to minors, must comply with NSW responsible service of alcohol requirements, and must be truthful about alcohol content and pricing. Events at known licensed venues may be automatically marked with 18+ badges.
Disclaimer: Hey Byron does not promote or encourage alcohol consumption. We are a discovery platform. The presence of alcohol-related events does not constitute our endorsement of alcohol consumption, any venue, or any event. Always drink responsibly and never drink and drive.

4.3 Copyright Compliance
You may only upload images and videos that you own or have permission to use. Prohibited activities include copying images from Google without permission, using photos from other businesses without permission, using copyrighted music, artwork, or media without a license, and using stock photos without appropriate licensing.
For copyright claims, if you believe content infringes your copyright, contact us at info@heybyron.com.au with a description of the copyrighted work, location of infringing content (business name, event title), your contact information, a statement that you have good faith belief the use is unauthorized, and a statement that information is accurate and you are the copyright owner or authorized to act on their behalf. We will investigate copyright claims promptly and remove infringing content as appropriate.
4.4 Our Right to Remove Content
We reserve the right to review, monitor, and remove any content at our sole discretion, including content that violates these Terms, may expose us to legal liability, is reported by other users, we determine is inappropriate, offensive, or harmful, violates alcohol advertising laws or regulations, targets minors or violates age restrictions, or contains false or misleading information. We may remove content without notice. Content removal does not relieve you of liability for content you posted.
4.5 Content Processing
When images or videos are uploaded, our system automatically compresses and optimizes them for app performance, resizes them to appropriate dimensions, converts them to appropriate formats (such as MP4 for videos), stores compressed versions on our servers in Australia, and may delete original uncompressed files after processing. Compressed versions may be lower quality than originals, but this is necessary for optimal app performance.
5. Reporting Inappropriate Content
If you see content that violates these Terms or is inappropriate, contact us at info@heybyron.com.au. Please include in your report a description of the issue, location of the content (business name or event title), why you believe it violates these Terms, screenshots if possible (optional), and your contact information (optional).
We will investigate reports within 48-72 hours for standard reports and more quickly for urgent safety concerns.
For urgent concerns regarding irresponsible alcohol promotion, contact Liquor and Gaming NSW at 1300 024 720. For illegal activity, contact NSW Police at 131 444 (non-emergency) or 000 (emergency).
6. Your Privacy and Data
6.1 What We Do Not Collect from Regular Users
We want to be transparent about what we do not collect. We do not collect personal information (no accounts required), your location data on our servers (stays on your device), your browsing history or tracking data, your contact list or photos, credit card or payment information, or your calendar data (stays on your device). Regular users use the App completely anonymously. Your preferences, saved events, and location data stay on your device and are never uploaded to our servers.
6.2 Data Storage
Data stored on your device only (local storage) includes your saved or favorite events, your interest preferences, distance and location filter settings, age confirmation status, and calendar event IDs for events you've added. This data never leaves your device. We cannot access it.
Data stored on our servers in Australia (Firebase australia-southeast1) includes business listings (public information), events created by businesses (public event information), images and videos uploaded by businesses (public content), business codes and account credentials, and business analytics (anonymized event view counts). All server data is public business information, not personal user data.
6.3 Privacy Policy
Your privacy is important to us. Our full Privacy Policy is available on our website and forms part of these Terms. By using the App, you agree to our Privacy Policy. Please read it carefully.
7. Device Permissions
7.1 Location Services
The App uses your device's location (with your permission) to show you nearby events in real-time, calculate distances to venues (for example, "2.5km away"), provide relevant local content based on your current location, and filter events by distance.
Important privacy information regarding location: Location data is used in real-time on your device only. Location data is not permanently stored on our servers. Your location data stays on your device (may be temporarily cached for performance). Location coordinates are never uploaded to our servers or shared with third parties. We may collect anonymized device information (device type, platform) through Firebase Analytics for app performance monitoring, but never your specific location coordinates.
7.2 Calendar Access
The App requests calendar permissions to add events you choose to your calendar with one tap. Important privacy information regarding calendar access: While the permission allows calendar access, we only write events to your calendar and never read or access your existing calendar entries. Calendar event IDs are stored locally on your device only (to manage events you've added). Calendar data never leaves your device or reaches our servers. We do not collect, access, or view your existing calendar entries.
7.3 Your Control Over Permissions
You have full control over device permissions at all times. Location permission can be enabled or disabled in Settings, then Hey Byron, then Location. Options include Never, Ask Next Time, or While Using the App. This can be changed anytime. Calendar permission can be enabled or disabled in Settings, then Hey Byron, then Calendars. This can also be changed anytime.
If you disable permissions, without location, distance calculations will not work and events will still be visible but not sorted by distance. Without calendar, you will not be able to add events with one tap and will need to add them manually. The App continues to function with reduced functionality if permissions are denied.
8. Intellectual Property
8.1 Our Content
All content on the App (excluding user-generated content) including the Hey Byron name, logo, and branding, App design, layout, and user interface, text, graphics, and images we create, and App code, software, and functionality is owned by us or our licensors and protected by Australian and international intellectual property laws.
8.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. You may not copy, modify, distribute, or create derivative works from the App, reverse engineer, decompile, or disassemble the App, remove copyright, trademark, or proprietary notices, use the App for commercial purposes without our written permission, extract, scrape, or harvest data using automated means, use the App to compete with us or develop a competing product, or rent, lease, sell, or sublicense the App. Violation may result in immediate termination and potential legal action.
9. Third-Party Links and Services
9.1 External Links
The App may contain links to external websites and services, including business websites, ticketing platforms, social media pages, Google Maps or Apple Maps, and alcohol brand or product websites.
We are not responsible for content, accuracy, or availability of external sites, privacy practices of external sites (they have their own privacy policies), transactions you make on external sites, security of external sites, alcohol service practices at venues, or products or services offered on external sites. Your use of external sites is at your own risk and subject to their terms and privacy policies. We do not endorse external sites.
9.2 Third-Party Services We Use
The App uses Firebase (Google Cloud Platform) for data storage, app functionality, and performance monitoring. The location is Australia (australia-southeast1 region). They receive business listings, events, images, videos, and anonymized usage data. Their privacy policy is available at policies.google.com/privacy.
The App uses Google Maps and Apple Maps for location services, mapping, and distance calculations. They receive location data only when maps are displayed, in real-time. Google's privacy policy is available at policies.google.com/privacy and Apple's is available at apple.com/legal/privacy.
The App uses Expo (React Native Development Platform) for app development platform, performance monitoring, and crash reporting. They receive technical data, crash logs, and anonymized performance metrics. Their privacy policy is available at expo.dev/privacy.
Your use of the App means you also agree to these third-party services' terms and privacy policies.
10. Disclaimer and Limitation of Liability
10.1 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights you may have under the Australian Consumer Law (ACL) in Schedule 2 of the Competition and Consumer Act 2010 (Cth). To the extent permitted by law, our liability for breach of any consumer guarantee that cannot be excluded under the ACL is limited to, at our option, re-supplying the services or paying the cost of having the services re-supplied.
